Description

This session will focus on compliance with federal and state laws regarding access to and disclosure of patient information. We will cover the rules governing minors and parents, special situations such as deceased individuals, health care proxy agents and powers of attorney, as well as time frames and fees for access. We will discuss the difference between access and disclosure of patient information, and review New York State and HIPAA requirements which apply to releasing information to third parties.

Frances A. Ciardullo, Esq.

Ms. Ciardullo has been a practicing attorney for over 40 years, concentrating in health care law. Throughout her career, she has represented health care institutions and individual practitioners on a broad range of issues. Ms. Ciardullo served as an Adjunct Professor in Health Law for the Syracuse University College of Law and on the teaching faculty for many educational institutions, including the New School for Social Research; the State University of New York Health Science Center; Cazenovia College; and the Institute for Health Care Ethics in Syracuse, New York. She has authored numerous articles for professional and legal publications, and is a frequent lecturer for healthcare providers and professional associations. Ms. Ciardullo is also trained in alternative dispute resolution and has mediated or arbitrated a variety of civil actions and attorney fee disputes.

Ms. Ciardullo received her B.A. from Cornell University and her J.D. from Syracuse University College of Law. For 22 years, she served as a Town Justice and was a member of the Senior Teaching Faculty for the New York State Office of Court Administration. She was appointed by the Chief Justice of the State of New York to the New York State Commission on Judicial Conduct, where she served as its Vice Chairman. She is a Past President of the Central New York Women’s Bar Association and formerly served as a director of the Onondaga County Bar Association.
