Proposed Modifications to the HIPAA Privacy Rule: Overview from the HHS Office for Civil Rights

This webinar features Timothy Noonan, JD, Deputy Director for Health Information Privacy at the Office for Civil Rights (OCR) at the U.S. Department of Health and Human Services. On December 10, 2020, OCR first announced a Notice of Proposed Rulemaking (NPRM) on Modifications to the HIPAA Privacy Rule. The Proposed rule was published in the Federal Register on January 21, 2021 which started the clock on a 60-day comment period which would have ended on March 22. On February 9, the comment period was extended 45 days to May 6, 2021.

The NPRM represents the first major modifications to the HIPAA Privacy Rule since 2013. According to OCR, the proposed modifications are designed to improve health information sharing for coordination of health care, empower individuals with their own health information, and lift unnecessary administrative burdens on covered health care providers and health plans. The proposals in the NPRM reflected extensive public comment received in response to its 2018 Request for Information on Modifying the HIPAA Rules to Improve Coordinated Care.

Mr. Noonan will overview the proposed changes and the rulemaking process. This webinar from OCR, the agency that administers and enforces the HIPAA Privacy Rule, benefits all health services stakeholders – Privacy and Compliance Officers, HIM Directors, Release of Information Managers, and legal counsels. Understanding the proposed changes, and the reasons for the proposal, will inform early planning to adapt organizational policies and practice. It will also help stakeholders who want to provide comments on the NPRM to do so before the extended deadline.

ROI as the Gatekeeper for Access and Disclosure Management Compliance

Release of Information (ROI) functions as the gatekeeper for access and disclosure of confidential health information. ROI advances patient rights, enforces organizational policy, and complies with federal and state law. The gatekeeper role is more complex today because:

  • Health delivery and information systems are more complex
  • Request volumes are greater from patients and a range of requestors
  • Regulatory ground rules were largely designed for a paper-based health system, and
  • Privacy and security are being deliberately and inadvertently put at risk.

This presentation will provide an update on privacy’s evolution through law, policy and attitudes. Recent proposed changes to the HIPAA Privacy Rule will be reviewed and their implications discussed. Approaches for identifying recurring compliance problems that constitute risk will be examined with examples and speakers will recommend mitigation strategies.

As we begin the third decade of the 21st century, privacy and security challenges are increasingly under attack. ROI can and must be proactive in adapting effective gatekeeper methods for access and disclosure of confidential health information.
